
This is one of those cases that reminds us of the collective punishment imposed on us at school: because of the bad behavior of a few, we have all been harmed. Talking about misbehavior is simply not accurate, because what the new regulation on inflatable boats tries to avoid is the perpetration of serious crimes such as smuggling and drug trafficking.
The "decree-law Royal of 16/2018 of October 26, 2006 adopting certain measures to fight against the illicit traffic of persons and goods in relation to the boats used" establishes the taking into account of the "forbidden kind" for the following boats :
-Pneumatic and semi-rigid boats which may be used for maritime navigation and which have any of the following characteristics:
• All those whose hull is less than or equal to 8 m. of length and power equal to or greater than 150 kW.
• All those with a hull greater than 8 m. total length.
-Pneumatic and semi-rigid boats on which there is rational evidence of intention to use them to commit or facilitate the commission of an act of contraband (such indications as the absence of registration, the modification of their compositions , systems handling, navigation without lights, etc).
The prohibition of such boats will affect the manufacture, repair, modification, circulation, possession or trade of such vessels, as well as the navigation at all points in our waters, whether inland or contiguous areas.
This will not affect, among others, the following boats:
• Auxiliary boats exclusively involved in the service of a main vessel.
• Persons involved in the exercise of commercial, sports, research or training activities.
• Pleasure boats intended for private use that meet the regulatory requirements set out in safety, technical and marketing documents.
For this, an essential prerequisite is the registration of the operator in the special register of operators of high-speed RIB and semi-rigid boats, located at the National Tax Control Agency, as well as the application for authorization for the use and registration of boats.
In summary, although the terms used as a "forbidden" kind or commodity suggest a demonization of this type of ship, it is actually about exercising adequate control over them and their operators so as not to be used to commit offenses.
